Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) is made electronically between the following parties in accordance with Law No. 6502 on the Protection of Consumers, the Regulation on Distant Contracts, and applicable international consumer protection laws.

Buyer:
This is a general contract applicable to any consumer (“Buyer”) purchasing from the Seller’s website.

2. SUBJECT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of İznik tiles, as detailed on the Seller’s website, purchased by the Buyer electronically.

3. PRODUCT INFORMATION

The specifications, quantity, and total price of the İznik tiles purchased by the Buyer shall be displayed on the Seller’s website and provided in the order confirmation.

4. PAYMENT & DELIVERY TERMS

Payment Method: Payments shall be made via credit and debit cards through the Seller’s website.
Delivery Time: Orders shall be delivered in accordance with the estimated shipping times of MNG Kargo and DHL Express.
Shipping Costs: Unless otherwise stated, shipping fees shall be paid by the Buyer.

5. RIGHT OF WITHDRAWAL

For orders within Turkey: The Buyer has the right to withdraw from this contract within 14 days without providing any reason, starting from the day the product is delivered.
To exercise the right of withdrawal, the Buyer must notify the Seller in writing via email at info@tene-art.com.
The Buyer must return the product in its original condition, unused, and with the invoice included.
The Seller shall refund the payment within 14 days of receiving the returned product, excluding return shipping costs, which shall be borne by the Buyer.
For international orders (outside Turkey): Buyers have the right to return the product within 14 days, provided they cover return shipping costs and the product is in its original, unused condition. Custom-made or personalized İznik tiles are exempt from this right.
If goods arrive damaged: Upon receipt of your order, carefully inspect the package. If you find any damage, do not accept the delivery. Take photos of the damaged goods, record the issue with the delivery officer, and send us an email at info@tene-art.com. We will send a replacement free of charge. If the Buyer fails to follow this process, the Seller may evaluate the case at its discretion and decide on a refund or replacement.

6. LIABILITY & WARRANTY DISCLAIMER

Each tile piece is uniquely handmade and hand-painted, meaning that slight variations in measurements, colors, and patterns may occur. These variations are not considered defects.
The Seller is not liable for damages resulting from improper installation, misuse, or external factors beyond the Seller’s control.
Unless otherwise stated, the Seller does not provide warranties beyond the statutory consumer rights.

7. FORCE MAJEURE

The Seller shall not be held responsible for delays or failures in performance caused by unforeseen circumstances beyond its control, including but not limited to natural disasters, pandemics, governmental regulations, wars, problems during custom clearance, or disruptions in transportation or supply chains. In such cases, obligations may be suspended or adjusted as necessary.

8. DISPUTE RESOLUTION & GOVERNING LAW

In case of disputes that may arise from this Agreement, the Buyer may apply to Provincial and District Consumer Arbitration Committees for disputes within the monetary limits determined annually by the Ministry of Customs and Trade or to Consumer Courts for cases exceeding these limits. The Buyer may apply to the relevant Arbitration Committees or Consumer Courts either in their place of residence or in the jurisdiction of the Seller.

This Agreement is governed by Turkish law, and in cases where international consumer protection laws apply, they shall be considered alongside Turkish regulations to the extent that they do not contradict mandatory provisions.

By placing an order, the Buyer confirms that they have read and accepted all the terms in this Agreement and the pre-order contract information available on the Seller’s website. The Buyer also acknowledges receipt of this Agreement via email along with the order confirmation and summary.

9. FINAL PROVISIONS

By completing a purchase on the Seller’s website, the Buyer acknowledges and accepts this Agreement.
This Agreement shall remain in effect unless terminated in accordance with the provisions herein.
